Reporting with INFLCR | NIL Quick Sheet | KSU's NIL Policy


The interim policy adopted by the NCAA allows incoming and current student-athletes to receive compensation for their name, image, and likeness ("NIL") without jeopardizing their eligibility.
 
Disclosure of NIL Activities
Student-athletes must disclose each potential agreement providing compensation for their NIL before entering into compensation agreements, whether verbal or written.

Disclosure process for KSU will be through INFLCR and approved by the Compliance Office.

Student-athletes cannot enter NIL contracts that:
  • Violate KSU's NIL Policy
  • Conflict with KSU's Institutional Values
  • Require activities that occur during a time when the student-athlete is engaged in official activities of the intercollegiate athletic program.
  • Compensate or otherwise induce the student for their attendance or for their performance / participation in a sport.
  • Use official broadcast footage or audio from official activities, since such material is the intellectual property of KSU or KSU's partners.
  • Compensate for work not performed.
  • May otherwise jeopardize the student-athlete's continued eligibility to participate in the sport.
 
KSU / KSUAA employees or any affiliated staff members may not:
  • Provide NIL compensation 
  • Directly or indirectly, facilitate agreements.
  • Otherwise induce a current or prospective student-athlete to attend or enroll at KSU, perform, or participate in an athletic event.
 
Boosters may enter into legitimate NIL deals with student-athletes that meet all requirements including no compensation or inducement for attendance or performance / participation in a sport.
 
The use of the KSU trademarks requires licensing approval from KSU and the Collegiate Licensing Company.
 
Student-athletes can use a professional service provider, such as an agent or company, for the purpose of securing compensation for the use of their NIL.   
 
Student-athletes who receive compensation for NIL activities are doing so in their individual capacity and not as employees, agents, or partners of KSU or the KSUAA.
  • Student-athletes are solely responsible for the payment of any applicable state or federal taxes for earned compensation for NIL activities.
  • Student-athletes who use their personal social media accounts for compensated NIL activities must make clear on their profiles that such endorsements are solely on behalf of the individual student-athlete and are not the endorsements of KSU or KSUAA.
 
Student-athletes who have an F-1 visa are still required to comply with state and federal visa and tax laws, which may prohibit their receipt of NIL compensation.
